TERMS & CONDITIONS
for Participation in Events Organized by Kadampa Meditationszentrum Hamburg e. V.
§ 1 GENERAL
The following information are General Terms and Conditions (GTC) and apply to all events organized by Kadampa Meditationszentrum Hamburg e. V. They regulate the relationship between the participant ("Participant") and Kadampa Meditationszentrum Hamburg ("KMC") as organizer.
These terms and conditions are available at any time at www.meditation-hamburg.de/agb-english.
The KMC reserves the right to change these GTC to an extent reasonable for the participant. The latest version of the GTC shall apply unless the participant objects to their validity within four weeks after becoming aware of them.
§ 2 PARTICIPATION
Participants can book into an event of the KMC and thus enter into KMC´s participation agreement via online booking or verbally on site. For a successful online booking, the booking system will send a confirmation email on behalf KMC.
The participation agreement generally ends after the end of the event; in the case of points cards it ends with the cancellation of the points or expiry of the validity period of the card; in the case of memberships it ends after the expiry of the validity period.
Membership in the context of participation in the program of the KMC does not include voting rights for this non-profit organization or any other obligations towards the KMC.
Memberships and the associated access to the program are not transferable.
Memberships can only be purchased for residents in the catchment area of the KMC: Hamburg and a radius of approx. 120 km. KMC may unilaterally cancel memberships with residents outside the catchment area at any time. KMC also reserves the right to allow exceptions for reasons considered valid by KMC.
The minimum term of memberships is 2 months, after which they are automatically extended by one month at a time. Monthly membership fees are collected simultaneously according to the selected payment option (PayPal, SEPA). The validity period of a member participation agreement starts the moment the payment for the relevant validity period is received by KMC.
Enrollment in the NKT-IKBU Foundation or Teacher Education Program is not automatic upon execution of the Participation Agreement as part of a membership, even though the selected membership may cover these programs. These programs are closed study groups and participants must enroll in them separately. All other program points included in a membership are automatically open for participation as of the start of the participation agreement.
When purchasing point cards, the participation agreement is valid for six months from the date of purchase.
For memberships, the type and extent of the participation options are available at meditation-hamburg.de/prices-donations-english. Point cards are valid for events listed under Wochenprogramm.
Online broadcasts (livestreams) are only available for members. Links may not be shared and people without membership may not be allowed to use them in any way.
§ 3 CancellationS, Terminations, Refunds
The participant can cancel or revoke his participation without giving any reason within the following periods:
Booking for participation in standard events can be canceled or revoked up to 2 hours before the start of the event.
For special events (Sonderveranstaltungen) exceptions to 3.1.1. may occur, the cancellation period specific to such an event will then be shown on the event page.
If the participant cancels the participation in accordance with the relevant cancellation period in writing (e.g. online via the user account in the booking system or by email) or verbally, the entire participation fee or the point of a point card will be credited by the KMC. This credit is thus immediately available for further bookings for similar events. For paid participation fees, a refund can also be requested in writing by email within 60 days in this case. If the event is simply not taken without written or verbal cancellation, the claim for credit and refund, if applicable, is forfeited.
The KMC reserves the right to cancel or terminate a booking (participation agreement) unilaterally, without notice and without giving reasons, at any time. This applies explicitly also in case of overbooked events.
In case of event cancellation on the part of the KMC, the KMC will reimburse the participant for any fees paid in advance, provided that the participant waives the right to rebook. The participant has to be informed about event cancellations by KMC.
Memberships can be terminated after the minimum term of two months at any time, by either party without giving reasons, and with a 7 days notice period to the next possible monthly expiration date. Termination by the participant must be requested by email and the validity period of a membership ends accordingly. This regulation explicitly does not apply to point cards.
§ 4 Fees & Payments
The current fees and prices published by the KMC apply in each case. Value added tax is already included in all prices and fees.
Fees and prices are generally due for the participant at the time of booking; at the latest, however, at the beginning of the event or, in the case of memberships, monthly, at the beginning of their period of validity.
Unless otherwise agreed, payment of the participation fee shall be made by PayPal, SEPA direct debit, bank transfer or on site in cash or by EC or credit card.
§ 5 LIABILITIES
In case of property damage or financial loss for which KMC is demonstrably responsible, liability is limited to cases of intentional and grossly negligent conduct of KMC or its representatives. In case of personal injuries, the KMC is only liable for culpable breaches of duty.
Events of the KMC are explicitly not therapeutic events.
§ 6 Data Protection & Privacy
Booking data will be stored and processed electronically by the KMC. The KMC is obligated not to pass on booking data. This applies in particular to the online registration of a participant profile with password-protected access.
Sound and image recordings of any kind by the participant are only permitted after consultation with the KMC.
The KMC reserves the right to take pictures and make sound recordings during events, to use them for advertising purposes of the KMC, unless a thus recorded participant explicitly objects to this.

§ 7 Other
All legal relations between the parties shall be governed by the laws of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
Should individual provisions of this agreement become invalid or incomplete, the remaining provisions shall remain unaffected.
The participant may assign their rights and obligations under the participation agreement to third parties only with the prior express consent of KMC.
